Privacy Policy

At HÔTEL GOUNOD, we take the issue of privacy very seriously. We believe in transparency and are committed to keeping our privacy practices, including how we treat your personal information, private. We know that you too take privacy seriously and we provide settings that allow you to choose how certain information is used by HÔTEL GOUNOD. This policy explains our privacy practices for hotel-gounod.com (referred to as the "Site") and our other services provided by AUX BERGES DU GARDON S.A.S., depending on where you live ("HÔTEL GOUNOD", as well as "we" and "us"). We will refer to the Site and our other services as the "Services.

 

SECTION 1 – Acceptance of Privacy Policy
In order to run our business and provide you with our Services, we need to process your personal information. By agreeing to our Terms of Use, you confirm that you have read and understand this policy, including how and why we use your information. If you do not want us to collect or process your personal information in the ways described in this policy, you should not use the Services. We are not responsible for the content or privacy policies or practices of our partners, third party websites or third party applications.


HÔTEL GOUNOD's Terms of Service require that all account owners be 18 years of age or older. Minors under the age of 18 and 13 or older are permitted to use the HÔTEL GOUNOD Services only with proper authorization and direct supervision of the account owner. Children under the age of 13 are not permitted to use HÔTEL GOUNOD or the Services. You are responsible for any activity by a minor on your account.
By using the Services, you agree that HÔTEL GOUNOD will use your information in the United States, Ireland and any other country in which HÔTEL GOUNOD does business. Please be aware that the privacy laws and standards in some countries, including the rights of authorities to access your personal information, may differ from those in the country in which you reside. We will only transfer personal information to countries where permitted by law, and we will take steps to ensure that your personal information continues to have appropriate protections. SECTION 2 – Information Collected or Received

As part of our Services, we collect and receive your personal information in several different ways. You can often choose what information you provide, but sometimes it is necessary for us to obtain certain information to enable you to use the Services and to enable us to provide them to you.


Registration, Account Setup and Use of the Services: To use the Services, you must provide us with a valid email address, and for those Services that require registration, a name associated with your account, which you can choose and which represents your identity on HÔTEL GOUNOD. You may review, edit or delete this name in your account settings. This information is necessary for us to provide the Services to you. Depending on the Services you choose to use, we may ask you for additional information to provide them to you, such as billing and payment information (including billing contact name, address, phone number, credit card information), phone number and/or physical mailing address. This information is not required when you register, but we will need it in order to provide certain services. For example, we need a physical mailing address if you purchase something on the Site that needs to be delivered to you. We may need to store credit card information (or arrange for it to be stored) and use it for both billing and payment purposes. Depending on your local jurisdiction, you may also choose to allow us to store your credit card information to facilitate ordering for future purchases.
Profile: You may provide your name and other personal information (such as city of residence) in connection with your account and business. You can edit or delete this information through your account settings.
Automated Information: HÔTEL GOUNOD automatically receives and records, from your browser or mobile device when you visit the Website or use the Applications or certain other Services, information such as your IP address or unique device identifier, cookies, and data about the pages you view, to enable us to administer and provide the Services. This information is stored in log files and is collected automatically. We may combine this information collected from your browser or mobile device with other information we or our partners collect about you, across all devices. This information is used to prevent fraud and maintain the security of the Services, to analyze and understand how the Services are performing for members and visitors, and to provide advertising on various devices and a more personalized experience for members and visitors.
We may also automatically collect device-specific information when you install, access or use the Services. This information may include information such as hardware model, operating system details, application version, application usage and debugging information, browser, IP address and device IDs. Location Information: We may also collect information about your use of the Services for purposes of advertising, analytics, distributing content and protecting the Services, including your IP address, browser information (including referrers), device information (iOS IDFA identifier, IDFV identifier used for limited non-advertising purposes, Android AAID identifier and, when enabled, location information provided by your device). We may use and store information about your location to provide features and to improve and personalize the Services, for example, to perform internal analysis and monitor the performance of HÔTEL GOUNOD; for location, regional settings and regulations regarding the Services; for local content, search results and recommendations; for geographic configuration of the Services; and for marketing (using general location information). If you have agreed to share specific location details about your device but no longer wish to share them with us, you may withdraw your consent to share this information in the settings of the Applications or your mobile device. Certain Services associated with general geographic location, such as for security and regulatory tracking based on your IP address or the address you provided, are necessary for the operation of the Site. We will share your location details with third parties (e.g., our card, payment service and, where applicable, advertising providers) solely for the purpose of providing the Services to you.


Analytics Information: We use data analytics technology to operate the Site and improve the Services. We use analytics software for mobile devices to help us understand the functionality of the Applications on your phone. This software may record information such as how often you use the Apps, what happens in the Apps, your cumulative usage of the Apps, performance data, errors that occur and debugging information, and where the Apps were downloaded from. We do not link the information we record in analytics software to any personally identifiable information you submit in the Mobile Application.
Information from Third Parties: Some members or visitors may choose to log into HÔTEL GOUNOD or create a HÔTEL GOUNOD account from an external third-party application, such as Facebook, or an application developed using the HÔTEL GOUNOD API. HÔTEL GOUNOD may receive information from these connected third-party applications. Connecting your HÔTEL GOUNOD account to third party applications or services is optional. If you choose to connect your account to a third party application, HÔTEL GOUNOD may receive information from that application. We may also collect public information to contact you. We may use this information when we provide the Services to you.
Non-Member Information: HÔTEL GOUNOD may receive or obtain information (e.g., an email address or IP address) about a person who is not yet a member of HÔTEL GOUNOD (a "non-member") in connection with certain features of HÔTEL GOUNOD, such as when a non-member chooses to subscribe to a HÔTEL GOUNOD newsletter, a member invites a non-member to visit the Site, a member sends a non-member a gift card code, or a non-member uses the Guest Order feature to make a purchase through one of the Services. Non-member information is used only for the purposes described when it is submitted to HÔTEL GOUNOD or to enable actions authorized by the non-member.


 

SECTION 3 – Choice and control
We know that members of our community value control over their own information, and therefore HÔTEL GOUNOD gives you the choice to provide, edit or delete certain information, as well as the choice of how we may contact you. You can change or correct your HÔTEL GOUNOD account information in your account settings. You may also delete certain optional information that you no longer wish to have publicly displayed via the Services, such as your name. You may also request that personal information be deleted from your account.
Depending on your location, you may also have additional rights with respect to your information, such as: (i) access to and portability of your data (including the right to obtain a copy of the personal data you have provided to HÔTEL GOUNOD through your settings); (ii) correction of data (including the ability to update your personal data, generally through the settings) ; (iii) deletion of data (including the right to request HÔTEL GOUNOD to delete your personal information, except for information that is necessary for us, by contacting us); and (iv) withdrawal of consent or objection to processing (including, in certain circumstances, the right to request HÔTEL GOUNOD to stop processing your personal data, with certain exceptions, by contacting us).
We use non-technically necessary cookies and similar technologies. You will find more details about the technologies we use and how you can refuse their use, if any, in the HÔTEL GOUNOD Rules and Regulations regarding cookies and similar technologies.
You can also control the receipt of certain types of communications from HÔTEL GOUNOD in your account settings. HOTEL GOUNOD may send you messages about the Services or your activity. Some of these messages are necessary because they relate to the Services for members (such as transaction-related messages or legal messages). Other messages, such as newsletters, are not necessary. You can choose which optional messages you wish to receive by modifying your account settings, and you can learn more in the "Messages from HÔTEL GOUNOD" section of this policy.
We partner with third parties to manage our advertising on other sites. Our third party partners may use cookies or similar technologies to provide you with advertising based on your browsing activities and interests.

SECTION 4 – Messages from HÔTEL GOUNOD
On occasion, HÔTEL GOUNOD may need to contact you. These messages are mainly transmitted by email, and each account must be associated with a valid email address to receive messages. HÔTEL GOUNOD may also contact you by telephone to assist you as a member or in connection with transactions if you request us to call you. In addition, and with your consent, HÔTEL GOUNOD may send you an SMS (or similar) message or postal mail to provide you with customer support or information about products and features that may be of interest to you. You can change your contact preferences in your account settings.
Some messages from HÔTEL GOUNOD are service-related and necessary for members and guest mode users. You agree that HÔTEL GOUNOD may send you non-marketing emails or messages regarding transactions, your account, security, or product changes. Some examples of service-related messages are: email address confirmation, welcome email upon account registration, order notification, service availability, changes to key features, transmission of conversations with purchasers, and communications with the HÔTEL GOUNOD support team.
When you create an account, subscribe to the newsletter, or provide us with your email address or phone number, you agree (in some jurisdictions and situations, by additional explicit agreement) to receive emails and marketing messages from us. You may unsubscribe from marketing emails at any time via the unsubscribe link contained in marketing emails or messages. Members may also control the delivery of certain emails or marketing messages through their account settings as well as through the unsubscribe link contained in emails or marketing messages.

 

SECTION 5 – Uses, sharing and disclosure of information
When you access or use the Services, we collect, use, share and process your personal information as described in this policy. We rely on a number of legal bases for using your information in this way. These legal bases include where:
- such uses are necessary to perform the contractual obligations set out in our Terms and Conditions and to provide the Services to you;
- you have consented to the processing, and can withdraw that consent at any time;
- such uses are necessary to comply with a legal obligation, court order, or to exercise or defend legal claims;
- such uses are necessary to protect the legitimate interests of a third party or our own, such as those of visitors, members or partners;
- you have expressly made this information public;
- the use of such information is in the public interest; and
- the use of this information is sometimes necessary to protect your vital interests or those of others.

Note that we rely primarily on consent (i) to send marketing messages, (ii) to share advertising-related data with third parties, and, where applicable, (iii) to use location data for advertising purposes.
When we process your information based on legitimate interests, we do so as follows:
Performing and improving our Services: We may use your information to improve and personalize our Services, and share your information to achieve these purposes, and we do so because it is necessary to exercise our legitimate interests in improving our Services for our users. It is also necessary to enable us to exercise our legitimate interests in understanding how our Services are used, as well as to explore and discover how we can develop our business. This is also necessary to enable us to exercise our legitimate interests in improving our Services, efficiency, making the Services attractive to our users and obtaining information about the usage patterns of our Services.
Maintaining the security of our Services: We may also use your information for safety and security purposes, and share your information to achieve these purposes, and we do so because it is necessary to exercise our legitimate interests in maintaining the security of our Services, including enhancing the protection of our community from spam, harassment, intellectual property infringement, fraud, and security risks of all kinds.
We respect your privacy. HÔTEL GOUNOD will not disclose your name, email address or other personal information to third parties without your consent, except as provided in this policy.
We use your information to provide and improve the Services and our products, for billing and payment purposes, for identification and authentication purposes, for targeted online and offline marketing, including through tools such as Facebook Custom Audiences or Google Customer Match, to contact members or interested parties, and generally for research and aggregated reporting. For example, we may use information you provide to us to resolve disputes that arise with HÔTEL GOUNOD or other partners. We may discover the types of products you are interested in as a result of your shopping and searching behavior on the Site (and elsewhere), and as a result, suggest potential purchases to you. A fundamental aspect of our Services is our legitimate interest in personalizing your experience on the Site to help you discover items of interest to you and recommendations for purchases. Similarly, we or our vendors may advertise our Services or our vendors' products through various media, and we rely on your consent to do so off-site. In doing so, we may work with advertising partners such as Facebook or Google.

Legislation and Security: HÔTEL GOUNOD may also retain or disclose your personal information to a third party in the following limited circumstances: in response to lawful requests from public authorities, including to meet legitimate national security or law enforcement requirements; to protect, establish or exercise our legal rights or defend against legal claims, including collecting a debt; to comply with a subpoena, court order, legal process, or other legal requirement; or when we believe, in good faith, that such disclosure is necessary to comply with the law, to prevent imminent personal injury or financial loss, or to investigate, prevent or take action regarding illegal activities, suspected fraud, threats to our property, or violations of the HÔTEL GOUNOD Terms of Use. In these particular cases, our use of your information may be necessary for a third party's or our legitimate interest in maintaining the security of the Services, preventing harm or criminal activity, asserting or defending legal rights, or preventing damage. Such use may also be necessary to comply with a legal obligation, court order, or to exercise or defend legal claims. If HÔTEL GOUNOD receives a legitimate and justified request to provide a partner's records or information in one of the limited circumstances described in the previous paragraph, HÔTEL GOUNOD may disclose such personal information, which may include, but is not limited to, the member's name, physical address, telephone number, email address and company name.
Affiliated Companies: HÔTEL GOUNOD is affiliated with and works closely with various companies for a variety of purposes, including helping us perform and improve the Services. These companies may sell you items or services or, with your consent, offer you promotions (including email promotions). HÔTEL GOUNOD may also provide services or sell products jointly with affiliated companies, including providing information to these partners to enable them to market their products to you more effectively. When an affiliate is involved in completing your transaction, we may need to share information about that transaction with them to make the transaction possible; this is part of the Services we provide in accordance with our Terms of Use. We rely on consent (which can be withdrawn at any time) to send marketing messages and to share advertising information with third parties.
 Aggregate Information: HÔTEL GOUNOD may share demographic information with business partners, but it will be aggregated and de-identified so as not to reveal personally identifiable information.


Service Providers: HÔTEL GOUNOD may also engage third party companies and individuals (e.g., payment processors, research firms, analytics and security providers) to assist us in performing, providing and selling the Services. These third parties have limited access to your information, may only use it to perform these tasks on our behalf, and are required by HÔTEL GOUNOD not to disclose or use your information for any other purpose. Engaging service providers is often necessary for us to provide the Services to you, particularly when those companies play an important role such as processing payments and shipments, and helping us to ensure the operation and security of our Services. In other cases, these service providers are not strictly necessary for us to provide the Services to you, but they do help us improve the Services, for example by helping us conduct research to learn how we might better serve our users. In the latter cases, we have a legitimate interest in working with these service providers to improve our Services.
Corporate Reorganization: In some cases, HÔTEL GOUNOD may choose to buy or sell assets. These transactions may be necessary and in our legitimate interest, particularly our interest in making decisions that enable our business to grow over the long term. We can only speak for ourselves; this policy does not apply to the practices of third parties that HÔTEL GOUNOD does not own or control, or to individuals who are not employed or directed by HÔTEL GOUNOD. If you provide your information to others, different practices may apply to the use or disclosure of the information you provide to them.

 

SECTION 6 – Security
The security of your personal information is important to us. We follow industry standards to protect the personal information provided to us, both during transmission and after receipt. Your account information is password protected. It is important for you to protect yourself from unauthorized access to your account and information by carefully customizing your password and keeping your password and computer secure, for example by logging out after using the Services. HÔTEL GOUNOD encrypts certain information (such as credit card numbers) using SSL (Secure Socket Layer) technology. HÔTEL GOUNOD applies the standards in force in the industry to protect the personal information which is communicated to us, as well during its transmission as after its reception. Unfortunately, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security.

 

SECTION 7 – Retention of information
HÔTEL GOUNOD will retain your information only for as long as necessary to fulfill the purposes set forth in this policy, as long as your account is active (i.e., for the life of your HÔTEL GOUNOD member account), as described in this policy or as necessary to provide you with the Services. If you do not want HÔTEL GOUNOD to continue to use your information to provide you with the Services, you may terminate your account. HÔTEL GOUNOD will retain and use your information to the extent necessary to comply with our legal obligations (e.g., if we need to retain your information to comply with tax/income laws), resolve disputes, enforce our commitments, and as otherwise described in this policy. In addition, HÔTEL GOUNOD vendors may need to retain and use your information to meet their legal obligations. Note that closing your account does not necessarily free up your email address, username or store name (if any) for use in a new account. We also retain log files for internal analysis. These log files are generally kept for a short period of time, except in cases where they are used for site security, to improve the functionality of the site, or if we are legally required to keep them for a longer period.

 

SECTION 8 – Your rights
You have a number of rights with respect to the information that belongs to you and that we process. Some of these rights apply only in limited circumstances and depending on your location. SECTION 9 – Withdrawal of consent
